New milestone for Schaeffler in the fight against piracy of its products

2017-04-03 18:51:20

Press Release- The end of a long process begun in 2015 to defend Schaeffler’s brand rights.

New milestone for Schaeffler in the fight against piracy of its products

BARCELONA, March 2017.

Thanks to close cooperation between the European Anti-Fraud Office (OLAF) and the Bizkaia Customs Surveillance Unit, in mid-2015 several containers with fake Schaeffler FAG brand bearings from China were seized in the French port of Le Havre. An intense investigation carried out by the relevant authorities culminated in the confiscation, in the warehouses of the import company, of a large volume of bearings identified with the “FAG” brand which, after the corresponding expert analysis, were found to be fake.

After almost two years of process and negotiations, with legal advice from the Industrial Property department of Cuatrecasas, Schaeffler has finally seen its claims recognised by the company, which has agreed to destroy the fake bearings, acknowledge the facts in public, pay considerable compensation for the damage caused and accept the imposition of penalties on the company or any of its managers if they commit this type of actions again.

This is a new landmark for Schaeffler Iberia in its constant struggle against product and brand piracy, providing evidence of its policy of zero tolerance and perseverance in combating this type of infractions.

This is not the first time Schaeffler has obtained such positive results in the defence of its rights. Back in 2015, the Madrid Provincial Criminal Court recognised an infringement of Schaeffler Iberia’s brand rights, ordering the infringing company at the time to pay 7.6 million euros in damages.

The SCHAEFFLER Brand Protection Team

In 2004 Schaeffler created a central body to combat piracy and violation of its products and brands. Since then, the Brand Protection Team has handled more than a thousand cases and has destroyed thousands of fake bearings. In no way are these cases exclusive to the Asia region, as demonstrated in this example. In Europe and the USA there have also been a large number of major cases of falsification and brand infringement. Thanks to these experiences around the world, the method used to combat these infringements has been perfected on an ongoing basis. The principal aim of this fight is to protect customers who buy INA and FAG products through the authorised distribution network. To this end, Schaeffler has assessed and certified its distributors all over the world, and a list of all of them can be found on its website www.schaeffler.es. This list also includes their certification number for inspection.

If you have the slightest doubt about the origin of any bearings, please get in touch with Schaeffler contact persons locally, or with the Brand Protection Team (piracy@schaeffler.com).
